{"id":2223,"date":"2024-03-24T14:56:00","date_gmt":"2024-03-24T14:56:00","guid":{"rendered":"https:\/\/www.rosarioduarte.pt\/regime-maior-acompanhado\/"},"modified":"2026-03-28T00:05:22","modified_gmt":"2026-03-28T00:05:22","slug":"regime-maior-acompanhado","status":"publish","type":"post","link":"https:\/\/www.rosarioduarte.pt\/en\/regime-maior-acompanhado\/","title":{"rendered":"Adult Supported Regime"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>What is the Adult Supported Regime?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The Adult Supported Regime (<em>Regime do Maior Acompanhado<\/em>) establishes legal measures for adults who, due to health conditions, disability, or behaviour, are unable to exercise their rights or fulfil their duties personally and consciously.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Who can apply?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The person themselves (beneficiary).<\/li>\n\n\n\n<li>The spouse, de facto partner, or close relatives who are heirs, with the person\u2019s consent.<\/li>\n\n\n\n<li>The Public Prosecutor\u2019s Office, without needing prior authorisation.\u200b<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Who acts as the support person ?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p>The court appoints the person it considers most suitable. Priority is usually given to the spouse, de facto partner, parents, children, or grandparents. If no relative is suitable, the court may appoint a representative or another capable person.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Note:<\/strong>&nbsp;Spouses and direct ascendants\/descendants (parents\/children) generally cannot refuse the role. After 5 years, some support persons may ask to be released or replaced.\u200b<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Scope of measures<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The regime must be limited to the\u00a0<strong>least restrictive necessary<\/strong>. Measures may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Representation (general or specific).<\/li>\n\n\n\n<li>Administration of assets (total or partial).<\/li>\n\n\n\n<li>Prior authorisation for certain legal acts.<\/li>\n\n\n\n<li>Exercise of parental responsibilities.\u200b<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Rights of the supported person<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The supported person retains fundamental personal rights, including the right to marry, enter into a de facto union, have children, adopt, travel, and conduct everyday transactions.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Is the role remunerated?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>No, the role is unpaid.
