With an enforcement title, the creditor can execute directly against the debtor\u2019s assets (for example, bank accounts or tax credits) without bringing a full ordinary court action.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Scope of application<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The procedure applies to obligations arising from contracts up to\u00a0<strong>\u20ac15,000.00<\/strong>\u00a0and to commercial transactions regardless of the amount. A \u201ccommercial transaction\u201d is any transaction between companies, or between companies and public entities, for the supply of goods or services, excluding consumer contracts.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How to submit the request<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The request must be filed electronically by a legal representative via the\u00a0<strong>National Injunction Office (BNI)<\/strong>. The form is straightforward: it identifies the parties, the notification address, and includes a brief statement of facts (the cause of action). The creditor must specify the principal amount, accrued interest, and other sums due. If notification is unsuccessful, the applicant must indicate the competent court to which the case should be transferred.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Subsequent steps<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Notification:<\/strong>\u00a0If the request complies with legal requirements, the debtor is notified and has\u00a0<strong>15 days<\/strong>\u00a0to pay or lodge an opposition.<\/li>\n\n\n\n<li><strong>Enforcement:<\/strong>\u00a0If the debtor neither pays nor opposes, the BNI secretary affixes an \u201cenforcement formula\u201d to the request, giving it the force of an enforcement title.<\/li>\n\n\n\n<li><strong>Opposition:<\/strong>\u00a0If the debtor opposes, the procedure is converted into a judicial action and allocated to the competent court.\u200b<\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>European Order for Payment<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>This instrument is used for\u00a0<strong>cross\u2011border cases<\/strong>\u00a0in which the parties are domiciled in different EU Member States.
