Before Law No. 83\/2021, essential aspects\u2014such as employee consent or prior notice for home inspections\u2014were not clearly defined.\u200b<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Duration:<\/strong>\u00a0Agreements can now be of indefinite duration (previously capped at three years).<\/li>\n\n\n\n<li><strong>Equality:<\/strong>\u00a0Article 169 clarifies that teleworkers must have the same rights and duties as on-site staff.<\/li>\n\n\n\n<li><strong>Workplace access:<\/strong>\u00a0Employers must give 24 hours\u2019 notice before visiting a teleworker\u2019s home.\u200b<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Rights for Parents<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>Telework is now a right (not just an option) for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parents of children under 3 years old.<\/li>\n\n\n\n<li>Parents of children up to 8 years old, provided that:<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Both parents can telework and alternate periods of equal duration within a 12\u2011month window; or<\/li>\n\n\n\n<li>It is a single-parent household; or<\/li>\n\n\n\n<li>Only one parent can demonstrably telework. In these situations, employers cannot oppose the request.\u200b<\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Safety and the \u201cRight to Disconnect\u201d<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Safety:<\/strong>\u00a0Work-related accidents are covered, but the telework arrangement must be formally communicated to the insurer, specifying the place and hours of work.<\/li>\n\n\n\n<li><strong>Right to disconnect:<\/strong>\u00a0Employers are prohibited from contacting employees outside normal working hours, except in cases of\u00a0<em>force majeure<\/em>.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Note on emails:<\/strong>\u00a0Opinions differ.
