In short, it offers greater flexibility in complying with punctuality obligations.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Who is eligible and how to obtain it?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>Any employee may benefit from this exemption, provided it is agreed in writing with the employer or allowed by a collective bargaining agreement or by law, and that it falls within the situations described in Article 218 of the Labour Code.\u200b<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Modalities of exemption<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The employer and employee may choose between three modalities:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Exemption from the maximum limits of normal working hours.<\/li>\n\n\n\n<li>An increase in the normal daily or weekly working period.<\/li>\n\n\n\n<li>Compliance with the normal working period, with freedom to choose starting and finishing times.\u200b<\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Remuneration and rights<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Rest periods:<\/strong>\u00a0The exemption\u00a0<strong>does not<\/strong>\u00a0undermine the right to mandatory or complementary weekly rest days, public holidays, or daily rest (generally 11 consecutive hours).\u200b<\/p>\n\n\n\n<p><strong>Supplementary pay:<\/strong>\u00a0Employees under this regime are entitled to a salary supplement.<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p class=\"ql-heading\">Duarte Marques Mano | <a href=\"mailto:info@rosarioduarte.pt\" target=\"_blank\" rel=\"noreferrer noopener\">info@rosarioduarte.pt<\/a><\/p>\n\n\n\n<p><a class=\"btn gray\" href=\"http:\/\/eepurl.com\/gyHAu1\" target=\"_blank\" rel=\"noopener\">Sign up for our Newsletter<\/a><br>\u00a0<\/p>\n\n\n\n<h5 class=\"wp-block-heading ql-heading\">Contact us and\/or book a meeting <a href=\"https:\/\/www.rosarioduarte.pt\/en\/contacts\/\">here<\/a>.<\/h5>\n","protected":false},"excerpt":{"rendered":"<p>What is the Exemption from Working Hours?
