{"id":2640,"date":"2020-04-14T12:28:08","date_gmt":"2020-04-14T12:28:08","guid":{"rendered":"https:\/\/www.rosarioduarte.pt\/o-regime-especial-de-moratoria-nas-rendas\/"},"modified":"2026-04-02T15:32:27","modified_gmt":"2026-04-02T15:32:27","slug":"o-regime-especial-de-moratoria-nas-rendas","status":"publish","type":"post","link":"https:\/\/www.rosarioduarte.pt\/en\/o-regime-especial-de-moratoria-nas-rendas\/","title":{"rendered":"Special Rent Moratorium Regime (COVID\u201119)"},"content":{"rendered":"\n<p>Following the declaration of the State of Emergency on 18 March and the resulting loss of income for many tenants, <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/lei\/4-c-2020-131193441\" target=\"_blank\" rel=\"noopener\">Law no. 4\u2011C\/2020<\/a> of 6 April created an exceptional regime for late payment of rent, commonly known as the <strong>rent moratorium<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What does this regime provide?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>It grants flexibility in rent payments to residential tenants who can demonstrate a reduction in income directly caused by the restrictions imposed during the State of Emergency.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Conditions for residential leases<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>The regime applies where both conditions are met:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A drop of more than 20% in household income compared with the previous month or the same period of the previous year.<\/li>\n\n\n\n<li>A household effort rate (housing costs \/ income) above 35%.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Effects of the moratorium<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Residential leases<\/strong> \u2013 The landlord cannot terminate the contract on the grounds of arrears.
