{"id":2518,"date":"2024-02-23T11:46:00","date_gmt":"2024-02-23T11:46:00","guid":{"rendered":"https:\/\/www.rosarioduarte.pt\/contrato-de-trabalho-a-termo-incerto-contrato-de-trabalho-a-termo-certo\/"},"modified":"2026-03-31T01:12:14","modified_gmt":"2026-03-31T01:12:14","slug":"contrato-de-trabalho-a-termo-incerto-contrato-de-trabalho-a-termo-certo","status":"publish","type":"post","link":"https:\/\/www.rosarioduarte.pt\/fr\/contrato-de-trabalho-a-termo-incerto-contrato-de-trabalho-a-termo-certo\/","title":{"rendered":"Contrat de travail \u00e0 terme certain et \u00e0 terme incertain"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>De quoi s\u2019agit\u2011il ?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>Le droit portugais pr\u00e9voit plusieurs formes de recrutement, dont le <strong>contrat de travail \u00e0 terme r\u00e9solutoire<\/strong>, qui comprend :<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contrat \u00e0 terme certain<\/strong> \u2013 Les parties fixent une date de fin pr\u00e9cise.<\/li>\n\n\n\n<li><strong>Contrat \u00e0 terme incertain<\/strong> \u2013 Le contrat a une dur\u00e9e limit\u00e9e, mais sa fin d\u00e9pend de la r\u00e9alisation d\u2019un \u00e9v\u00e9nement futur sans date exacte.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>Dans les deux cas, le contrat est <strong>limit\u00e9 dans le temps<\/strong>. La diff\u00e9rence essentielle tient \u00e0 la mani\u00e8re dont la fin est d\u00e9termin\u00e9e : par une date fixe (terme certain) ou par l\u2019\u00e9v\u00e9nement convenu (terme incertain).<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dans quels cas conclure un contrat \u00e0 terme incertain ?<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>Uniquement dans les hypoth\u00e8ses pr\u00e9vues par la loi, lorsqu\u2019un \u00e9v\u00e9nement, bien que limit\u00e9 dans le temps, n\u2019a pas de date pr\u00e9cise. Exemples :<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Remplacement temporaire d\u2019un salari\u00e9 absent.<\/li>\n\n\n\n<li>R\u00e9alisation d\u2019une t\u00e2che, d\u2019un ouvrage ou d\u2019un projet sp\u00e9cifique.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dur\u00e9e du contrat \u00e0 terme incertain<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>En principe, il dure le temps n\u00e9cessaire au remplacement du travailleur absent ou \u00e0 l\u2019ach\u00e8vement de l\u2019activit\u00e9 ou du projet, sans pouvoir <strong>exc\u00e9der 4 ans<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Renouvellement<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>Le contrat \u00e0 terme incertain ne se renouvelle pas : il prend fin d\u00e8s que la condition est r\u00e9alis\u00e9e.
