{"id":2641,"date":"2020-04-14T12:28:08","date_gmt":"2020-04-14T12:28:08","guid":{"rendered":"https:\/\/www.rosarioduarte.pt\/o-regime-especial-de-moratoria-nas-rendas\/"},"modified":"2026-04-02T15:37:58","modified_gmt":"2026-04-02T15:37:58","slug":"o-regime-especial-de-moratoria-nas-rendas","status":"publish","type":"post","link":"https:\/\/www.rosarioduarte.pt\/fr\/o-regime-especial-de-moratoria-nas-rendas\/","title":{"rendered":"R\u00e9gime Sp\u00e9cial de Moratoire sur les Loyers (COVID\u201119)"},"content":{"rendered":"\n<p>\u00c0 la suite de la d\u00e9claration de l\u2019\u00e9tat d\u2019urgence le 18 mars et de la baisse de revenus qui en a r\u00e9sult\u00e9 pour de nombreux m\u00e9nages, la <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/lei\/4-c-2020-131193441\" target=\"_blank\" rel=\"noopener\">Loi n\u00b0 4\u2011C\/2020<\/a> du 6 avril a instaur\u00e9 un r\u00e9gime exceptionnel pour les retards de paiement des loyers, couramment d\u00e9sign\u00e9 sous le nom de <strong>moratoire sur les loyers<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Objet du r\u00e9gime<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>Il offre une flexibilit\u00e9 de paiement aux locataires d\u2019habitation qui prouvent une diminution de leurs revenus directement li\u00e9e aux restrictions impos\u00e9es pendant l\u2019\u00e9tat d\u2019urgence.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Conditions pour les baux d\u2019habitation<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p><br>L\u2019application du r\u00e9gime suppose la r\u00e9union des deux conditions suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Baisse de plus de 20% du revenu du foyer par rapport au mois pr\u00e9c\u00e9dent ou \u00e0 la m\u00eame p\u00e9riode de l\u2019ann\u00e9e pr\u00e9c\u00e9dente.<\/li>\n\n\n\n<li>Taux d\u2019effort du foyer (co\u00fbt du logement \/ revenu) sup\u00e9rieur \u00e0 35%.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Effets du moratoire<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Baux d\u2019habitation<\/strong> \u2013 Le propri\u00e9taire ne peut pas r\u00e9silier le contrat pour cause de retard de paiement.
