What is a civil liability/damage claim?

 

A civil liability /damage claim is a formal legal motion containing:

  • Asummary of facts supporting the claim;
  • Damages suffered, categorized as:
    • Pecuniary damages (financial losses, medical expenses);
    • Non-pecuniary damages (pain, suffering, moral harm — not subject to strict economic valuation).

 

Who can file a claim?

 

  • Injured Party (victim of crime damages, whether or not joined as Assistente);
  • Public Prosecutor’s Office;
  • Persons with purely civil liability.

 

Once identified, injured parties receive notification from Judicial Authorities (Prosecutor, Judge) or Criminal Police (PSP, PJ, GNR).

 

When must it be filed?

 

Timing depends on the party’s procedural role:

  • Victim/Assistant/Injured Party (who declared intent to claim): With indictment OR separate motion after defendant notification;
  • Victim unable to join as Assistente: Within 10 days of indictment notification.

 

Required contents of the claim

 

  1. Court identification;
  2. Case number/process number;
  3. Identification of all parties;
  4. Statement of facts supporting the claim;
  5. Prayer for relief (specific amount claimed).
